TERMS & CONDITIONS APPLICABLE FOR THE DOC3 SERVICE. 

BY USING THIS SERVICE, YOU ARE CONSENTING TO BE BOUND BY THIS AGREEMENT. 

The service provider grants you a non-exclusive license to use the online Doc3 application and its subscription/add-ons and benefit from the resulting output.

DISCLAIMER OF WARRANTY.

This service and its associated online functionality are provided on an “AS IS” basis, without warranty of any kind, including without limitation the warranties of merchantability, fitness for a particular purpose and non-infringement. The entire risk as to the quality and performance of the service, including online access, is borne by you. Should the service prove defective, imperfect or unsatisfactory in any way, you and not the service provider assume the entire cost of any service and repair. In addition, the security mechanisms implemented in the application and resulting output have inherent limitations, and you must determine that they sufficiently meet your requirements. This disclaimer of warranty constitutes an essential part of the agreement.

LIMITED WARRANTY.

The service provider warrants the service, if operated as directed, will substantially achieve the functionality described online.

The service provider does not warrant, however, that your use of the service, its online functionality and value or subsequent output will be uninterrupted, or that associated operation will be error-free or secure.

THIS IS A LIMITED WARRANTY AND IT IS THE ONLY WARRANTY MADE BY THE SERVICE PROVIDER. THE SERVICE PROVIDER MAKES NO OTHER EXPRESS WARRANTY AND NO WARRANTY OF NON-INFRINGEMENT OF THIRD PARTIES’ RIGHTS, THE DURATION OF IMPLIED WARRANTIES, INCLUDING WITHOUT LIMITATION, WARRANTIES OF MERCHANTABILITY AND OF FITNESS FOR A PARTICULAR PURPOSE.

NO DEALER, AGENT, REPRESENTATIVE OR EMPLOYEE OF THE SERVICE PROVIDER IS AUTHORIZED TO MAKE ANY MODIFICATIONS, EXTENSIONS, OR ADDITIONS TO THIS WARRANTY.

LIMITATION OF LIABILITY.

Under no circumstances and under no legal theory, tort, contract, or otherwise, shall the service provider or his suppliers or representatives be liable to you or any other person or entity for any direct, indirect, special, incidental, or consequential damages of any type, including, without limitation, damages for loss of goodwill, delays, work stoppage, computer failure or malfunction, or any and all other commercial damages or losses. In no event will the service provider be liable for any damages incurred by you in connection with or as a result of use of this service, even if the service provider shall have been informed of the possibility of such damages, or for any claim by any other party.

SUBSCRIPTION SERVICES. 

The Doc3 service is a free service that is offered with modules available on a subscription basis and prepaid by credit card or other online payment options. What is stated above and in the following with regard to applicable terms, limited warranty and liability shall apply both to the basic free version and any and all subscription services.

TERMINATION.

The Doc3 service is partially offered free and is accessible to anyone logging on to the online Doc3 site (www.doc3.com). The service provider may at any given moment without any notice cease to offer this service and/or related subscriptions, or adapt it for other use.

To terminate your free use account, please send a notification email to notify@doc3.com, stating your user-ID and clearly stating in English what you want to cancel, i.e. account and/or subscription.

If you have signed up for a subscription, it is automatically renewed at the end of the term. For termination of a subscription, the user is required to terminate his subscription by using the cancel feature in the Account Settings.

In case of termination by the user before the end of a subscription period (one month), the subscribed service will continue to operate until the end of the period and cease. When terminating a subscription, the user is urged to download any private data beforehand since this data will be automatically deleted after the end of the subscription period.

DATA INTEGRITY.

Users of the Doc3 service are strongly encouraged to back up all data uploaded to and processed on their Doc3 user account.

User data will be deleted after one month in the following cases:

• Termination of account
• Termination of a subscription. Only data related to the subscription will be deleted. Note, especially that the deleted data cannot be recreated by resuming the subscription at a later time.
• Non-payment of the subscription fee. The provider will send reminders to all users of subscription, including successful payments, unsuccessful payments and any other details pertaining to the payment for such subscription.
  

CONFIDENTIALITY.

The service provider is bound by secrecy and shall not reveal client data, including uploaded files, to a third party. Additionally, the service provider shall not use this data, including uploaded files, for his own gain, and he is further bound to permanently delete any user files within the stipulated auto deletion period (currently 30 calendar days). Any stored data will also be deleted upon expiration of the user’s paid subscription such as if the user cancels a subscription or his account.

MISCELLANEOUS.

This Agreement may exist in different language versions, however, in case of disputes, this English version shall take precedence over any other language version and remain the one and only enforceable agreement between you, the user, and the service provider.

THE ACCEPTANCE OF ANY OUTPUT RECEIVED AS A RESULT OF REQUESTS PLACED ONLINE BY YOU OR USING THE DOC3 APPLICATION BY ITSELF OR TOGETHER WITH ANY OTHER APPLICATIONS IS EXPRESSLY MADE CONDITIONAL ON YOUR CONSENT TO THE TERMS & CONDITIONS SET FORTH HEREIN.

If any provision of this Agreement is held to be unenforceable, such provision shall be reformed only to the extent necessary to make it enforceable, while the remainder of the agreement shall continue to be enforced.

This Agreement shall be governed by the legal code applicable in the country of the service provider.

All future improvements, upgrades and new functionality of the service shall, unless accompanied by revised terms, be subject to all the terms & conditions as well as restrictions mentioned herein. This agreement is available online at Doc3.com where the service is hosted, and its terms and content may change from time to time. This Agreement shall be the only enforceable Agreement between the Service Provider and the User.
